英文合同中“租赁”一词的常见表达

英文合同中,有很多词汇可以表达“租赁”,常见的有lease,rent,hire,let,charter等。具体用法可参考如下实例:

 

(1) lease: 常指根据合同进行租赁大型设备、土地等,通常租赁时间也比较长。

 

To develop and turn to account any land acquired by the Company or in which the Company is interested, and in particular by laying out and preparing the same for building purposes, constructing, altering, pulling down, decorating, maintaining, furnishing, fitting up, and improving buildings, and by planting, paving, draining, farming, cultivating, letting on building lease or building agreement, and by advancing money to and entering into contracts and arrangements of all kinds with builders, tenants and others.

將本公司所獲取或持有權益的任何土地發展和加以利用,尤其是將該等土地整理和準備作建築用途,建造、改動、清拆、裝飾、保養、布置、裝備和改善建築物,以及進行種植、鋪路、排水、種植、耕作、以租地建築契或建築協議 出租,並向各類建造商、租客及其他人墊 付款項,以及與他們訂立各種合同和安排。

 

In accordance with the provisions of HKAS 17, a lease of land and building should be split into a lease of land and a lease of building in proportion to the relative fair values of the leasehold interest in the land element and the building element of the lease at the inception of the lease.

根據HKAS 17之條文,凡土地及樓宇之租約,應在租約開始時參照租賃中土地租賃權益與樓宇租賃權益的相對公平值,按比例分為土地租賃部分與樓宇租賃部分。

 

(2) rent: 最常见的“租赁”。有时与let并用,构成let on rent,表示出租。

To sell, exchange, mortgage, charge, let on rent, share of profit, royalty or otherwise, grant licences, easements, options, servitudes and other rights over, and in any other manner deal with or dispose of, all or any part of the undertaking, property and assets (present and future) of the Company for any consideration and in particular (without prejudice to the generality of the foregoing) for any securities.

出售、交換、按揭、質押、出租、分享溢利、使用費或其他、授予特許、地役權、購股權、使用 權及與此有關之其他權利,及以任何其他方式處理或處置本公司所有或任何部分之業務、物業及資產(現有及未來),以換取任何代價,尤其是(在不損及上述各項之一般性原則下)任何證券。

 

(3) hire: 常见于杂物及劳务租用,时间短

On the effectiveness of the interim measures, DS/ETW(T)3 said that as a taxi driving licence’s holder would need to hire a taxi for providing taxi service, the trade could play a frontline guarding role effectively by checking the Hong Kong identity cards of hirers.

關於中期措施成效的問題,環境運輸及工務局副秘書長(運輸3)表示,持有的士駕駛執照的人士須租賃的士才可提供的士服務,有關業界可透過檢查租車人士的香港身份證,可以有效地發揮前線把關作用。

 

(4) let: 常见于英国的房屋租赁

To manage, demise, let or agree to demise and let, to accept surrenders of, to mortgage, sell and absolutely dispose of, to surrender to the Crown, to grant rights or way and other easements over, or otherwise howsoever to deal with all or any, either or any part or parts of the Company’s lands and hereditaments, messuages and tenements, or any estate or interest therein respectively.

管理、批租、出租或同意管理、批租、出租;接收、按揭、出售與全權處置、向官府交還本 公司全部或任何、任何一種或任何一個或多個部分的土地與可繼承產、宅院或物業單位及其 各自之內任何產業權或權益,就以上所述授出權利或通道權及其他地役權,或作出任何其他 處理。

 

 

(5) charter:常见于海商法。用于租赁大型交通工具如飞机、轮船等,必须签订租约。

Ninety days commencing from the day when the carrier has been identified, or the registered owner or bareboat charterer has rebutted the presumption that it is the carrier, pursuant to article 37, paragraph 2.

自识别承运人之日起,或自船舶登记所有人或光船承租人根据第三十七 条第二款推翻其为承运人的推定之日起九十日内。

 

合同中经常出现同义或近义词并用的情况,“租赁”在合同中出现时,也通常不止出现上述的某一个,在翻译时就比较考验中文使用功底。如:

 

To carry on all or any of the business whether together or separately of proprietors, promoters, producers, organisers, and managers of all kinds of public entertainments, sports, recreation, competitions, and amusements whether indoor or outdoor and in connection therewith to purchase, lease, hire, construct, provide, operate, equip, furnish and fit out any necessary or convenient land, buildings, facilities, structures, apparatus and equipment.

聯同他人或自行經營作為各類大眾娛樂、體育、文娛、競賽及消閑活動(不 論室內或戶外)東主、推廣人、製作人、策劃人及經理之所有或任何業務, 以及就該等業務購買、租賃、租用、建設、提供、營運、配備、裝修及配置 任何必需或方便之土地、樓宇、設施、構築物、儀器及設備。

 

To acquire, develop, manage, license, hire, let, sell, exchange and otherwise howsoever turn to account any land and/or building and, in particular, by laying out and preparing the same for building purposes, constructing, altering, demolishing, pulling down, decorating, administering, maintaining, furnishing, fitting up, and improving buildings of all kinds, and by planting, paving, draining, farming, cultivating, letting on building lease or building agreement or for sale, and by advancing money to and entering into contracts and arrangement of all kinds with builders, tenants and others in connection with any of the foregoing.

收購、開發、管理、特許使用、租賃、出租、出售、交換及以其他方式利用 任何土地及/或樓宇,尤其為建築目的透過設計及平整而建設、改建、拆卸、 裝飾、管理、維護、裝修、裝置及改善各類樓宇,栽種、鋪平、排污、養殖、 耕作、根據樓宇租約或建築協議出租或出售,及就上述任何項目向建築商、 租戶及其他人士墊付款項及與彼等訂立各類合約及安排。
